Tint Veteran Installation Contract

This Agreement (“Contract”) is entered into between Tint Veteran, holding California contractor license number #816297, with its primary business address at 3355 Corte Del Cruce, Carlsbad, CA 92009 (“Tint Veteran” or “Contractor”), and the Buyer as specified in the proposal upon the Buyer’s digital approval of said proposal.

Project Overview

Tint Veteran agrees to furnish and install, or furnish only, the products and services outlined in the attached Work Proposal and any associated addendums. The Buyer shall remit payment to Tint Veteran in accordance with the terms outlined in this Contract and accompanying documents.

Scope of Work

Tint Veteran will provide the specified window film installation services as described in the attached Work Proposal.

Payments

Unless previously agreed to in writing within this proposal, the Buyer acknowledges and agrees to the following payment terms:

Deposit:

A 50% deposit is required before the start of installation. If the project is canceled after the deposit is paid and materials have been ordered, the deposit will be non-refundable.

Balance:

Upon successful completion of the project, the remaining balance is due in full.

Late Payment:

If payment is not received within 15 days of the project’s completion, a late fee of 5% will be applied to the total project amount. Additionally, a 1.5% fee will be compounded monthly on the unpaid balance until paid in full.

Mechanics Lien

If payment is not received within 30 days of project completion, Tint Veteran reserves the right to file a mechanics lien in accordance with applicable laws and regulations. This clause serves as the Buyer’s preliminary notice. Taking this step ensures compensation for services rendered. Prompt attention to payment will prevent such actions.

Rescheduling and Trip Charge

If installation is rescheduled on the same day as the original appointment or while installers are already en route, a trip charge will apply. This charge covers travel expenses and payroll costs due to scheduling disruptions.

Trip Charge Details

Rescheduling on the same day of installation: A trip charge between $75 and $300 will be added to the invoice. The specific amount will depend on distance and time factors. This policy reflects our commitment to providing reliable service while compensating our team for reserved time and travel. We appreciate your cooperation in maintaining scheduled appointments.

Insurance

Tint Veteran maintains general liability and workers’ compensation insurance. Additional certificate holders may be added upon the Buyer’s request. The Buyer is responsible for any additional insurance requirements, waivers, or endorsements.

Contractor State License Board (CSLB)

Contractors are regulated by the Contractors’ State License Board. For any questions or concerns, please contact the CSLB.

Attorney Fees

In any dispute arising from this Contract, the prevailing party shall be entitled to recover attorney fees and related costs.

Other Fees

Additional consulting services may be provided upon request and will be billed based on the actual time spent.

Performance and Payment Bond

At the Buyer’s request, Tint Veteran may provide a performance and payment bond, with the associated costs paid by the Buyer.

Arbitration of Disputes

Any disputes under this Contract shall be resolved through arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association.

Access and Responsibilities

The Buyer is responsible for ensuring clear access to the work area, including the removal of all non-affixed items located within 3 feet of the glass. Tint Veteran will comply with all applicable laws and regulations.

Valuable and Breakable Items

The Buyer is responsible for removing any items that may be at risk during installation.

Governing Law

This Contract shall be governed by the laws of the State of California.

Entire Agreement

This Contract, along with any addendums, constitutes the complete agreement between the parties.

Warranty

Warranty coverage begins upon project completion and full payment. Coverage is provided by the manufacturers and is subject to their specific terms and conditions.

By digitally approving the proposal, both parties acknowledge their understanding and acceptance of the terms outlined in this Contract.
