This Agreement ("Contract") is entered into between Tint Veteran, with California contractor license number #816297, having its primary address at 3355 Corte Del Cruce, Carlsbad, CA 92009 ("Tint Veteran" or "Contractor"), and the Buyer as specified in the proposal upon the buyer digitally approving the proposal.
Project Overview Tint Veteran agrees to furnish and install, or furnish only, the products and services outlined in the attached Work Proposal and addendums. The Buyer shall remit payment to Tint Solutions in accordance with the terms outlined in this Contract and accompanying documents.
Scope of Work Tint Veteran will provide the specified window film installation services as detailed in the attached Work Proposal.
Payments Unless previously agreed to in writing within this proposal, The Buyer acknowledges and agrees to the following payment terms:
Deposit: A 50% deposit is required before installation begins. If the project is cancelled after deposit is paid and materials have already been ordered, the deposit will not be refunded.
Balance: Upon successful completion of the project, the remaining balance is due in full.
Late Payment: If the payment is not received within 15 days from the project's completion date, a late fee of 5% will be applied to the total project price. Furthermore, an additional fee of 1.5% will be compounded for each subsequent month until the outstanding balance is settled in full.
Mechanics Lien In the event that payment is not received within 30 days from the project's completion date, Tint Veteran reserves the right to initiate a mechanics lien filing in accordance with applicable laws and regulations. This statement is to serve as the buyer’s preliminary notice. This step may be taken to secure payment for services rendered. Your prompt attention to payment matters will help prevent such actions.
Rescheduling and Trip Charge In the event of a rescheduled installation, if the rescheduling occurs on the same day of the original appointment or while our installers are en-route to the location, a trip charge will be incurred. This charge is intended to cover travel expenses and payroll costs associated with the scheduling disruption. Trip Charge Details Rescheduling on the same day of the installation: Trip charge ranging from $75 to $300 will be added to the invoice. The exact trip charge amount will be determined based on distance and time considerations. The trip charge reflects our genuine commitment to accommodating your needs while ensuring fair compensation for our dedicated team members and time slots filled for scheduling. Your understanding and cooperation in honouring scheduled appointments are greatly appreciated.
Insurance Tint Veteran carries standard general liability and workers' compensation insurance. Additional certificate holders can be added upon request by the Buyer. The Buyer is responsible for additional coverage, waivers, or endorsements, if necessary.
Contractor State License Board (CSLB) Contractors are regulated by the Contractors State License Board (CSLB). Any questions or concerns about a contractor can be directed to the CSLB.
Attorney Fees The prevailing party in any dispute arising from this Contract is entitled to recover attorney fees and costs.
Other FeesAdditional consulting services may be provided upon request and will be billed based on actual time spent.
Performance and Payment Bond Upon Buyer's request, Tint Veteran may obtain a performance and payment bond, with expenses covered by the Buyer.
Arbitration of Disputes Any disputes arising from this Contract shall be resolved through arbitration, as per the construction industry arbitration rules of the American Arbitration Association.
Access and Responsibilities The Buyer is responsible for providing clear access to the work area including removing any and all non-affixed items in front of the glass at least 3 feet away. Tint Veteran shall comply with all applicable laws and regulations.
Valuable and Breakable Items The Buyer is responsible for removing items that could be imperilled due to installation activities.
Governing Law This Contract is governed by the laws of the State of California.
Entire Agreement This Contract, along with addendums, constitutes the entire agreement between the parties.
Warranty Warranty coverage is activated upon completion of the project and final payment. Coverage is provided by manufacturers and subject to conditions.
By digitally approving the proposal, the parties acknowledge their understanding and agreement with the terms outlined in this Contract
